Employer Sponsorship & Nomination Requirements

Standard Business Sponsorship (SBS)

Before sponsoring a worker for a SID 482 visa, an employer must become an approved Standard Business Sponsor (SBS).

  • The business must be lawfully operating in Australia.

  • The business must demonstrate a genuine need for the skilled position.

  • Must comply with sponsorship obligations, including fair wages and working conditions.

Nomination Application

Once SBS approval is granted, the employer must nominate a position before the worker can apply for a visa.

  • The position must be on the relevant skilled occupation list.

  • Salary must meet the Temporary Skilled Migration Income Threshold (TSMIT).

  • The business must demonstrate a genuine need for the role.

  • Labour Market Testing (LMT) may be required unless an exemption applies.

Labour Agreements – A Flexible Sponsorship Pathway

For businesses that do not meet the standard sponsorship criteria or require workers for occupations that are not on the standard skilled occupation lists, a Labour Agreement provides a customised pathway for sponsorship.

What is a Labour Agreement?

A Labour Agreement is a formal negotiation between an employer and the Australian Government, allowing businesses to sponsor overseas workers under special conditions.

  • Suitable for industries experiencing chronic skill shortages.

  • Allows businesses to sponsor workers in occupations not on the standard skilled lists.

  • Can offer concessions on English language, salary requirements, or age limits for permanent residency pathways.

Types of Labour Agreements

  1. Company-Specific Agreements - Tailored to an individual employer’s needs.

  2. Industry Agreements - Available for sectors with recognised shortages (e.g., hospitality, agriculture, meat processing).

  3. Designated Area Migration Agreements (DAMA) - Designed for regional employers needing access to overseas workers.

  4. Project Agreements - For infrastructure or resource projects with a workforce shortage.

  5. Global Talent Employer Sponsored (GTES) Agreements - For highly skilled niche roles that are not easily filled in Australia.
